Cleanup of Contaminated Office/Warehouse Property

The owner of a $5.1 million office/warehouse property approached a commercial bank to secure a loan.  The property had contaminated groundwater with an estimated remedial cost of $500,000.  The bank offered a $2 million loan with a $750,000 reserve for cleanup and required a personal guarantee, collateral pledge, and environmental indemnification.  The owner turned to ECAP.

ECAP was able to place a $3.8 million, five-year, non-recourse loan, and replace the guarantee and indemnification with remedial and environmental liability insurance policies.

Redevelopment of Former Metal Fabricating Site

ECAP brought an interested developer a project that involved the acquisition, cleanup, and redevelopment of a 10-acre, former metal fabricating site with soil and groundwater contamination from leaking underground storage tanks.

ECAP partnered with a qualified team to purchase the property, structure the deal, raise the necessary capital, and negotiate environmental insurance coverage utilizing the Commonwealth of Massachusetts' brownfield redevelopment program to dramatically reduce costs and transfer liability.  The site has been successfully developed into a supermarket, providing an anchor for regenerating an urban neighborhood.

Groundwater Remediation

An investment fund advisor wanted to purchase a property for a pension fund client.  Legal counsel and the fund managers were uncomfortable with the site’s ongoing groundwater remediation work, which called for a four-year, $750,000 cleanup.

ECAP developed an eight-year, $2 million policy that guaranteed the cleanup, making the purchase possible.
